IN THE MATTER OF L.A.M. AND W.FJ.
On Appeal from the 393rd District Court Denton County, Texas
Trial Court No. 15-08580-393, Honorable Douglas M. Robison, Presiding
MEMORANDUM OPINION
Before QUINN, C.J., and CAMPBELL and HANCOCK, JJ.
Appellant, W.F.J., filed a notice of appeal on December 9, 2015. The court reporter's record was due on January 19, 2016, and, being indigent, he was entitled to it without cost to him. On January 22, the court reporter notified us that W.F.J. had not requested preparation of the reporter's record. By letter dated January 28, we directed W.F.J. to request preparation of the reporter's record and to certify to the court, in writing, whether he had complied with the court's order or provide a reasonable explanation for his noncompliance. See TEX. R. APP. P. 35.3(b)(2). We admonished W.F.J. that failure to do so by February 8 would result in dismissal of the appeal. See TEX. R. APP. P. 42.3(c).
To date, W.F.J. has not requested the reporter's record and has not filed any response regarding his compliance with the court's order. The appeal is therefore dismissed because W.F.J. failed to comply with requirements of the appellate rules and an order of the court. TEX. R. APP. P. 42.3(c).
