Appeal by Juvenile from orders entered 23 January 2015 by Judge W. Turner Stephenson, III in Halifax County District Court. Heard in the Court of Appeals 20 October 2015.

Jacob is a pseudonym used to protect the juvenile's identity.

Even if the trial court denied the motion, it might have based its adjudication on subsection 14–160(a)—a Class 2 misdemeanor—instead of subsection 14–160(b), which constitutes a Class 1 misdemeanor.
