Opinion issued October 7, 2009.

Original Proceeding on Petition for Writ of Mandamus.

Panel consists of Justices KEYES, HANKS, and ALCALA.

MEMORANDUM OPINION

The underlying cases are In the Interest of Spencer Kelly Castner, Minor Child, Cause No. 2004-66050, in the 257th Judicial District Court of Harris County, Texas, the Hon. Judy Warne, presiding, and In the Interest of Phoenix Younger Bachman, A Child, Cause No. 2008-24499, in the 257th Judicial District Court of Harris County, Texas, the Hon. Judy Warne, presiding.

By petition for writ of mandamus, relator, David Arnold Northrop, seeks mandamus relief compelling the trial court to vacate its rulings from August 5, 2009 and orders from August 25, 2009, striking Northrop's petition in intervention.

We deny the petition for writ of mandamus. All outstanding motions are overruled as moot. We lift the stay entered by this Court on September 21, 2009.
