MEMORANDUM OPINION NUNC PRO TUNC


Relator is seeking post-conviction relief from his murder conviction. Only the Texas Court of Criminal Appeals has jurisdiction in final post-conviction felony proceedings. See Tex. Code Crim. Proc. Ann. art. 11.07 (Vernon 2005); In re McFee, 53 S.W.3d 715, 717 (Tex.App.-Houston [1st Dist.] 2001, no pet.). Accordingly, we DISMISS relator's petition for writ of mandamus. See Tex. R. App. P. 52.8(a).

Dear Mr. Nix:

Enclosed is a corrected copy of the memorandum opinion issued on December 20, 2007 in the original proceeding, 05-07-01611-CV. The December 20, 2007 memorandum opinion contained a typographical error in the cause number. The enclosed memorandum opinion nunc pro tunc has a corrected the cause number to 05-07-01611-CV. The only correction made in the opinion is the cause number.

Please replace your memorandum opinion with the newly corrected copy.
