MEMORANDUM OPINION


Relator, Maria Phuong Nguyen, M.D., has filed a petition for writ of mandamus complaining of an alleged ruling of the trial court, further alleged to have been made on July 22, 2005, denying relator's motion to dismiss.

The Honorable Robert E. May, judge of the 149th District Court of Brazoria County, Texas. The underlying lawsuit is William G. Selfridge III Michelle Selfridge, Individually as Representatives of Caleb Logan Selfridge, a Minor, Deceased v. Maria Phuong Nguyen, M.D., trial court cause number 33556.

After due consideration, the Court denies the petition for writ of mandamus.
