Appellate Division of the Supreme Court of New York, First Department
May 26, 2000
709 N.Y.S.2d 814 (N.Y. App. Div. 2000)

Opinion

May 26, 2000.

Order, Supreme Court, New York County (Helen Freedman, J.), entered November 12, 1999, which denied defendant Crown's motion for summary judgment dismissing the complaint, unanimously affirmed, without costs.

Thomas A. Egan and A.C. and S., Inc., etc., et al., Defendants.

Before: Wallach, J.P., Lerner, Rubin, Buckley, JJ.

Drawing all reasonable inferences in favor of plaintiffs, the party against whom summary judgment is sought, the affidavit of a welder who worked on the same ship as did the injured plaintiff is sufficient to raise an issue of fact as to whether the latter was exposed to his employer's predecessor's asbestos products (see,Reid v. Georgia-Pacific Corp., 212 A.D.2d 462).

THIS CONSTITUTES THE DECISION AND ORDER OF SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
