ON APPLICATION FOR A WRIT OF MANDAMUS CAUSE NO. 769937 IN THE 337TH DISTRICT COURT FROM HARRIS COUNTY

ORDER

Per curiam.

Relator has filed a motion for leave to file an application for a writ of mandamus under this Court's original jurisdiction. He contends that the Harris County District Clerk is not sending him copies of the trial court records that he specifically requested and paid for (i.e., pre-trial transcripts/documents, including the "minute entry docket sheet") related to trial cause number 769937. Relator alleges that the district clerk instead keeps sending him copies of the documents that pertain to proceedings that occurred from the start of trial to the end of trial, but not those pertaining to the pre-trial proceedings.

Respondent, the District Clerk of Harris County, is ordered to file a response with this Court and may include any exhibits in support of the response. The district clerk shall specifically answer whether Relator requested and paid for copies of pre-trial documents; whether such documents exist; whether it has sent Relator copies of the aforementioned documents; and if not has not sent Relator copies, why it has not done so. This motion for leave to file will be held. Respondent shall comply with this order within thirty days from the date of this order.
