On Appeal from the 59th Judicial District Court Grayson County, Texas Trial Court Cause No. CV-22-1175
ORDER
ROBERT D. BURNS, III CHIEF JUSTICE
We requested jurisdictional briefing in this appeal, which was filed October 3, 2023, as it was filed before a final judgment had been signed. See Tex. R. App. P. 26.1 (deadline for filing notice of appeal runs from date judgment is signed); Lehmann v. Har-Con Corp., 39 S.W.3d 191, 1915 (Tex. 2001) (appeal may generally only be taken from final judgment that disposes of all parties and claims). On December 13, 2023, after the parties had filed requested jurisdictional briefing, the trial court signed a final judgment. Accordingly, we now have jurisdiction over the appeal. We DIRECT the Clerk of the Court to correct our case management system to reflect the date the judgment was signed as December 13, 2023, rather than March 29, 2023, the date currently in the system, and to reflect the notice of appeal was filed the same day, but after, the final judgment was signed. See Tex. R. App. P. 27.1(a). All appellate deadlines shall be recalculated to run from the December 13th judgment, and any amended docketing statement shall be filed no later than February 20, 2024.
We DIRECT the Clerk of the Court to send a copy of this order to Kelly Ashmore, Grayson County District Clerk; Gale H. Fiasco, Official Court Reporter for the 59th Judicial District Court; and the parties.
