ORDER


The Court, this date, has entered a report, finding that Triple A Fire Protection, Inc. is presently financially unable to comply with the Eleventh Circuit Court of Appeals' Order of March 3, 1998. Specifically, Respondent is unable to "rescind its unlawful unilateral changes in wage rates and benefits and resume participation in and contributions to the fringe-benefit fund plans to which Respondent stopped contributions effective April 22, 1991" (11th Cir. file, Doc. 22, § III). Pursuant to these findings, the Court has recommended that the Motion for Summary Judgment filed by Triple A Fire Protection, Inc. be granted and that the Motion for Summary Judgment filed by the National Labor Relations Board be denied.

Therefore, the Court Clerk is directed to submit the Court's Report and Recommendation to the Eleventh Circuit Court of Appeals along with the entire Court file, including exhibits and transcripts. All future pleadings should be directed to the Court of Appeals.
