DECISION & ORDER ON MOTION

Motion by the appellant on appeals from two orders of the Family Court, Orange County, dated June 20, 2011, and November 29, 2011, respectively, to enlarge the record on the appeal from the order dated November 29, 2011, to include the original papers and transcripts of any proceedings which occurred in connection with matters entitled People v Naajib J., which had been pending in the Newburgh City Court, Orange County, under Index No. 10-03261, and People v Naajib J., which had been pending in the County Court, Orange County, under Indictment No. 2011-254 and Index No. 4260-2011, which were removed to the Family Court, Orange County, and proceeded in that court under Docket No. E-5303/11, and to be furnished with the transcripts of any proceedings in those matters.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted, the record on the appeal from the order dated November 29, 2011, is enlarged to include the original papers and transcripts of any proceedings which occurred in connection with matters entitled People v Naajib J., which had been pending in the Newburgh City Court, Orange County, under Index No. 10-03261, and People v Naajib J.,which had been pending in the County Court, Orange County, under Indictment No. 2011-254 and Index No. 4260-2011, and the Clerk of this Court, or her designee, shall subpoena the court file in those proceedings from the Newburgh City Court and the County Court, Orange County; and it is further,

ORDERED that the stenographer(s) and/or the transcription service(s) is/are required promptly to make and certify two transcripts of the proceedings in the matters entitled People v Naajib J., which had been pending in the Newburgh City Court, Orange County, under Index No. 10-03261, and People v Naajib J.,which had been pending in the County Court, Orange County, under Indictment No. 2011-254 and Index No. 4260-2011, if available, except for those minutes previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts of the proceedings in the Newburgh City Court shall be filed with the clerk of that court and both transcripts of the proceedings in the County Court, Orange County, shall be filed with the clerk of that court, and the clerks of each of those courts shall furnish one of such certified transcripts to the attorney for the appellant, George E. Reed, Jr., Esq., 222 Mamaroneck Avenue - #303, White Plains, N.Y. 10605, without charge; in the case of transcription services, one transcript of the proceedings in the Newburgh City Court shall be filed with the clerk of that court and one transcript of the proceedings in the County Court, Orange County, shall be filed with the clerk of that court, and one transcript of the proceedings in each court shall be delivered to the attorney for the appellant. The attorney for the appellant shall provide copies of said transcripts to all of the other parties to the appeals, when the attorney for the appellant serves a brief upon those parties; and it is further,

ORDERED that attorney for the appellant shall serve a copies of this decision and order on motion upon the clerks of the Newburgh City Court, the County Court, Orange County, and the Family Court, Orange County.
