The reporter's record in this case is overdue. By postcard dated August 16, 2023, we notified both Belinda Baraka, Official Court Reporter for the 194th Judicial District Court, and Norma Rico, the court reporter in the Auxiliary Court where the case was heard, that the record was overdue and directed that the record be filed within thirty days. By order dated October 17, 2023, we again notified both Ms. Baraka and Ms. Rico that the record was overdue and ordered the record to be file on or before November 6, 2023. To date, the reporter's record has not been filed.
So that this appeal can proceed, we ORDER Norma Rico to file, within TWENTY DAYS of the date of this order, either (1) the reporter's record; (2) written verification no hearings were recorded; or (3) written verification appellant has not requested the reporter's record. We notify appellant that if we receive verification the reporter's record has not been requested, we will order the appeal submitted without the reporter's record. See Tex. R. App. P. 37.3(c).
We expressly CAUTION Ms. Rico that failure to comply with the Court's order may result in an order for a hearing to determine why the record has not been filed and/or an order that she not sit as a court reporter until such time as she complies with the Court's order.
We DIRECT the Clerk of the Court to send a copy of this order to:
