LC No. 2021-002230-CZ

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction. The September 29,2022 order, which denied the motion to set aside the judgment of foreclosure, is not a final order appealable by right. MCR 7.203(A)(1); MCR 7.202(6)(a). Moreover, the claim of appeal is untimely from the February 16, 2022 judgment of foreclosure. MCR 7.204(A)(1). It was not filed within 21 days of entry of the judgment of foreclosure. MCR 7.204(A)(1)(a). And, the motion to set aside the judgment of foreclosure was not filed within the initial 21-day appeal period. MCR 7.204(A)(1)(d). Dismissal is without prejudice to whatever other relief may be available consistent with the court rules.
