MEMORANDUM OPINION


Before the Court are (1) relator's June 10, 2004 petition for writ of mandamus; (2) real party in interest's June 24, 2004 response; and (3) real party in interest's June 23, 2004 motion to dismiss petition for writ of mandamus and for sanctions and damages. In light of our opinion in Thomas Francis Moroch v. Christy Collins Calvert (Moroch), No. 05-03-00492-CV, issued September 6, 2005, relator's petition is DENIED as moot. Real party in interest's motion to dismiss petition and for sanctions is DENIED.
