ORDER MODIFYING OPINION AND GRANTING PETITION FOR MODIFICATION

THE COURT:

The petition for modification of the opinion filed herein on March 28, 2012 is granted as follows:

(1) On page 6, the second sentence of footnote 3 is deleted.

(2) On page 19, the first sentence of footnote 7 is modified to read:

Because the Board did not state its decision in writing, the only insight we have as to the rationale for finding Morganti currently dangerous are the statements of the two members of the panel at the close of the parole hearing.

These modifications do not effect a change in the judgment.
