ORDER DENYING PLAINTIFF'S MOTION SEEKING EXCEPTION FROM PACER FEE


THIS PROCEEDING came on for consideration of the Plaintiff's Motion Seeking Exception from the PACER Fee, filed on October 29, 2004 (Document No. 186). The Court has considered the Motion, together with the record, and finds that it is without merit.

"PACER" is the acronym for "Public Access to Court Electronic Records," a service of the United States Judiciary. The PACER system allows an individual, using the internet to access the bankruptcy court's public database and extract information. The Judicial Conference of the United States, the governing body of the federal judiciary, has imposed user fees to support this program. The Judicial Conference Advisory Notes to 28 U.S.C. § 1930 explain that PACER fees should not be waived in the absence of exceptional circumstances.

Plaintiff's motion states no reason for waiver of PACER fees in this proceeding, which has been pending since January 2, 2001, but expanded earlier this year to add defendants. In his motion, Plaintiff provides no justification for the requested relief. The Court notes that other parties are required to serve Plaintiff with all documents filed in this proceeding. There is no demonstrated prejudice to Plaintiff.

Accordingly, the Plaintiff's motion is denied.
