IN RE MOL

LC No. 18-089257-DM

Kathleen Jansen Presiding Judge Michael J. Kelly Christopher P. Yates Judges

ORDER

The motion for immediate consideration is GRANTED.

The complaint for superintending control is DENIED. Plaintiff has failed to carry his burden of establishing extraordinary circumstances warranting a remedy. In re Gosnell, 234 Mich.App. 326, 341-342; 594 N.W.2d 90 (1999). He has failed to identify any action taken by Judge Jon A. Van Allsburg in violation of this Court's May 31, 2024 order. This Court's authority to exercise superintending control extends only to inferior courts, not private individuals. Therefore, on this Court's own motion for clarification in lieu of superintending control, MCR 7.216(A)(7), this Court ORDERS that the parties are free to file motions in the lower court, but the lower court may not rule on the merit of those motions until this Court lifts its stay of the proceedings or resolves the pending appeal.
