IN THE INTEREST OF M.J.H., Child

From the 45th Judicial District Court, Bexar County, Texas Trial Court No. 2022PA01786 Honorable Charles E. Montemayor, Judge Presiding

ORDER

PER CURIAM

In this accelerated appeal, Appellant's brief was due on February 8, 2024. On February 20, 2024, after no brief was filed, this court ordered Appellant to submit a brief or have the case remanded for an abandonment hearing.

On February 29, 2024, Appellant filed a response, stating that no appellate attorney was appointed until February 22, 2024. Appellant asked for more time to submit the opening brief.

As of March 11, 2024, no opening brief has been filed. Understanding that appellate counsel, Manuel Rodriguez, was appointed at the end of February, we now order him to file the opening brief within ten days of this order.

If Appellant fails to respond as ordered, we will abate this appeal to the trial court for an abandonment hearing. Cf. id. R. 38.8(b)(2); Herndon v. Tex. Dep't of Family & Protective Servs., No. 03-11-00030-CV, 2012 WL 896010, at *1 (Tex. App.-Austin Mar. 13, 2012, no pet.) (mem. op.); In re T.V., 8 S.W.3d 448, 449 (Tex. App.-Waco 1999, order).
