MEMORANDUM OPINION

Original Mandamus Proceeding PER CURIAM Sitting: Sandee Bryan Marion, Chief Justice Patricia O. Alvarez, Justice Irene Rios, Justice PETITION FOR WRIT OF MANDAMUS DENIED

This proceeding arises out of Cause No. 10-422, styled Gary M. Poenisch v. Michael Middleton, pending in the 451st Judicial District Court, Kendall County, Texas, the Honorable Bill R. Palmer presiding.

On April 26, 2018, relator filed a petition for writ of mandamus and a motion for temporary relief. After considering the petition, this court concludes relator is not entitled to the relief sought. Accordingly, the petition for writ of mandamus is DENIED. See TEX. R. APP. P. 52.8(a). Relator's motion for temporary relief is also DENIED.
