ORDER
PER CURIAM
On Friday, December 15, 2023, relator Metropolitan Transit Authority of Harris County, Texas filed a petition for writ of mandamus and an emergency motion to stay in this court. See Tex. Gov't Code Ann. § 22.221; see also Tex.R.App.P. 52. In the petition, relator asks this court to compel the Honorable Kristen Brauchle Hawkins, presiding judge of the 11th District Court of Harris County, to vacate the trial court's December 11, 2023 order "granting plaintiff's motion to strike defendant's designation of alleged responsible third-party Jamin Stocker."
In its motion to stay, relator seeks to stay the trial currently set on a two-week trial docket commencing January 1, 2024.
It appears from the facts stated in the petition and motion that relator's request for relief requires further consideration and that relators will be prejudiced unless immediate temporary relief is granted. We therefore GRANT relator's motion and issue the following order:
We ORDER the trial in cause number, 2016-18317, Terry Smith v. Metropolitan Transit Authority of Harris County, Texas, STAYED until a final decision by this court on relator's petition for writ of mandamus, or until further order of this court.
Additionally, we request the real party in interest file a response to relator's petition for writ of mandamus by January 16, 2024.
