This cause is before the Court on the Objection of HCA Inc. ("HCA"), formerly known as HCA — The Healthcare Company and Columbia/HCA Healthcare Corporation, to the Ex Parte Order Approving Procedures to Be Used by Disbursing Agent, Determining Unsecured Claims for Purposes of Term Sheet, and Fixing Time to Objection to Proposed Disbursements by Disbursing Agent ("Ex Parte Order").
It appearing to the Court through counsel, that the parties have amicably resolved the Objection, permitting HCA to participate in the Term Sheet Agreement as set forth below.
IT IS, THEREFORE, ORDERED, ADJUDGED, AND DECREED, by consent, that HCA's Objection to the Ex Parte Order be and hereby is withdrawn; that HCA shall be permitted to participate in the Term Sheet Agreement with a single claim for $9,500,000.00, which sum is hereby accepted and approved; that the Unsecured Creditor Committee's web site shall be revised to reflect the terms of this Order no later than 5 days from the date of the entry of this Order; and that HCA shall have the right to revise and mail its ballot to the Disbursing Agent at the address below (postmarked no later than 10 days from the date of the entry of this Order) accepting the terms of the Offer, its treatment in this Order, and the terms of the Ex Parte Order referenced in the Offer.
