JUDGMENT AND ORDER
This matter having come before the Disciplinary Commission of the Supreme Court of Arizona, it having duly rendered its decision, and no discretionary or sua sponte review occurring,
IT IS ORDERED, ADJUDGED AND DECREED that CHESTER R. LOCKWOOD, JR., a member of the State Bar of Arizona, is hereby suspended from the practice of law for a period of six months, retroactive to March 8, 2010, for conduct in violation of his duties and obligations as a lawyer, as disclosed in the Disciplinary Commission Report.
IT IS FURTHER ORDERED that CHESTER R. LOCKWOOD, JR., shall be placed on probation for a period of one year on the following terms:
1. The period of probation will commence upon the date of the judgment and order and run concurrently with Respondent's probation in SB-09-0024-D.
2. Respondent shall contact the director of MAP within thirty days of the date of the Judgment and Order. Respondent shall submit to a one-time MAP assessment to determine his need for any services and/or assistance. If deemed necessary by MAP, the director of MAP shall develop "Terms and Conditions of Probation" and the terms shall be incorporated herein by reference. Respondent shall be responsible for any costs associated with MAP.
3. The State Bar shall report material violations of the terms of probation pursuant to Rule 60(a)(5), Ariz. R. Sup. Ct., and a hearing may be held within thirty days to determine if the terms of probation have been violated and if an additional sanction should be imposed. The burden of proof shall be on the State Bar to prove non-compliance by a preponderance of the evidence.
IT IS FURTHER ORDERED that pursuant to Rule 60(b), the State Bar of Arizona is granted judgment against CHESTER R. LOCKWOOD, JR., for costs and expenses of these proceedings in the amount of $1,487.50, together with interest at the legal rate from the date of this judgment. Respondent shall pay the costs and expenses within thirty days of the date of the judgment and order.
