Opinion

Decided August 12th, 1936.

On application for writ of habeas corpus.

Mr. Irving Eisenberg and Mr. Frederick M. Barnes, Jr., for the petitioner.

Mr. John J. Fallon, appearing amicus curiae.


Since filing the memorandum in the above matter I have been informed by counsel for the prisoner that he desires to have this matter reviewed by the court of errors and appeals. For this reason I will allow the writ to issue, and upon return and issue joined it will be dismissed. The production of the prisoner will be waived.
