Original Proceeding 58th District Court of Jefferson County, Texas Trial Cause No. 23DCCV1824
Before Golemon, C.J., Horton and Johnson, JJ.
ORDER
PER CURIAM
The Medical Center of Southeast Texas, LP d/b/a The Medical Center of Southeast Texas, Steward Health Care System LLC, and Steward Health Care Holdings LLC, Relators, filed a petition for a writ of mandamus and a motion for temporary relief. See Tex. R. App. P. 52. Relators are defendants in Trial Cause Number 23DCCV1824, HNIMSO, Inc., and HNI Physician Services of Texas, Inc. v. The Medical Center of Southeast Texas, LP, et al. Relators seek a writ compelling the Judge of the 58th District Court of Jefferson County, Texas, to vacate that part of a discovery order, signed on January 16,2024, which requires Relators to produce documents relating to the sale of hospitals owned by the parent companies of the Relators. See Tex. Gov't Code Ann. § 22.221.
Relators request that the Court of Appeals stay the challenged portion of the trial court's order of January 16, 2024 while this Court considers the mandamus petition. The Court finds temporary relief is necessary to prevent undue prejudice. It is ORDERED that the relief granted in items 2, 3, and 4 of the trial court's First Amended Order Granting Plaintiffs' Emergency Motion for Expedited Discovery in Trial Cause Number 23DCCV1824, which compelled production of contracts for the sale of hospitals, closing documents for the sale of hospitals, and documents reflecting the funds generated by the sale of hospitals, is STAYED until our opinion issues or until further order of this Court. See Tex. R. App. P. 52.10(b). No bond is required of Relators as a condition to any relief herein granted.
The response of the Real Parties in Interest, HNI MSO, Inc., and HNI Physician Services of Texas, Inc., is due February 5, 2024.
MOTION FOR TEMPORARY RELIEF GRANTED.
