MEMORANDUM OPINION
PER CURIAM
Relators have filed a petition for writ of mandamus and an emergency motion for temporary relief. After fully considering Relators' petition, this court is of the opinion that the petition should be denied. See TEX. R. APP. P. 52.8(a). Accordingly, Relators' petition for writ of mandamus is denied, and their emergency motion for temporary relief is overruled as moot.Panel consisted of Worthen, C.J., Griffith, J., and Hoyle, J.

ON THIS DAY came to be heard the petition for writ of mandamus filed by RUSSELL W. MCFADIN, ET AL., relators in Cause No. 713-10, pending on the docket of the 115th Judicial District Court of Upshur County, Texas. Said petition for writ of mandamus having been filed herein on February 27, 2012, and the same having been duly considered, because it is the opinion of this Court that this writ of mandamus should not issue, it is therefore CONSIDERED, ADJUDGED and ORDERED that the said petition for writ of mandamus be, and the same is, hereby DENIED and the emergency motion for temporary relief is OVERRULED AS MOOT.
