Gen. No. 43,592. (Abstract of Decision.)
Opinion filed April 24, 1946 Rehearing denied May 10, 1946 Released for publication May 10, 1946
PARENT AND CHILD, § 3 — when evidence supported decree denying custody of illegitimate child to father. On appeal seeking to reverse decree denying respondent's counterclaim praying for custody and control of his illegitimate child under Bastardy Act, where it appeared that respondent had denied paternity of child under oath in bastardy proceeding and refused to contribute to her support, and that child was given good home by parties who wished to adopt her, held that findings and decree were amply supported by evidence (Ill. Rev. Stat. 1945, ch. 17, par. 13; Jones Ill. Stats. Ann. 109.163).
