MEMORANDUM OPINION
Michael David Springer appeals from a judgment rendered in his divorce case. He did not file an affidavit of indigence "with or before" his notice of appeal. TEX. R. APP. P. 20.1(c)(1). Springer did not file a motion for extension of time to file an affidavit of indigence. TEX. R. APP. P. 20.1(c)(3). He was instructed by letter to pay the filing fee of $125 in this appeal when it was filed. No fee was paid. On February 17, 2006, Springer was informed by letter that the payment of the filing fee was past due. Springer was also warned that if the filing fee was not paid within ten days, the appeal would be presented to the Court for dismissal. See TEX. R. APP. P. 5, 42.3(c). As of today, Springer has not paid the filing fee.
Therefore, this appeal is dismissed. See Gordon v. Gordon, 167 S.W.3d 61, 62 (Tex.App.-Waco 2005, no pet.).
