ORDER MODIFYING OPINION

BENKE, Acting P. J.

THE COURT:

The opinion filed May 1, 2009 in the above matter is modified as follows:

1. Page 3, final clause before the section entitled "Factual and Procedural Background," the word "may" is changed to "should." That clause shall now read: (2) in the event the Mexican courts dismiss Husband's action for lack of jurisdiction over Wife or otherwise refuse to resolve the merits of the case, the trial court should dissolve the stay and resume proceedings in this California action.

2. Page 26, in the Disposition section, clause (2), the word "may" is changed to "should." That clause will now read: (2) in the event the Mexican courts dismiss Husband's action for lack of jurisdiction over Wife or otherwise refuse to resolve the merits of the case, the trial court should dissolve the stay and resume proceedings in this California action.

THERE IS NO CHANGE IN JUDGMENT.
