ORDER MODIFYING OPINION AND DENYING REHEARING [NO CHANGE IN JUDGMENT]

THE COURT:

It is ordered that the opinion filed herein on November 25, 2008, be modified in the following particulars:

1. The sentence starting on page 4, and continuing onto page 5, beginning “We do not even” is deleted and the following sentence is substituted in its place:

The designated record on appeal did not even include the motion to compel, only references to it in the register of actions—although we granted appellant’s motion for augmentation to add the motion to the record.

There is no change in the judgment.

The petition for rehearing is denied.
