ORDER
Before this Court are self-represented Appellant Peter Grigg's Motion for Extension of Time to file an Amended Opening Brief and Appellee Tiffaney Grigg's response filed by counsel, noting that the Notice of Entry of Judgment, filed in the Lincoln County District Court, occurred more than two weeks ago. Peter has included only the last page of the Lincoln County District Court's Order for the Payment of Reasonable Attorney's Fees and Costs, issued on February 28, 2022.
This Court has held this matter in abeyance since August 24, 2021, until the District Court issued an order determining attorney fees and costs. We ordered Peter not to file his opening brief until he informed this court in writing with notice of the District Court's written order. He has not given notice to this Court in a timely fashion. A notice of the District Court's Order needs to be filed with this Court.
As Tiffaney explains, his motion for extension of time is premature, because he has not filed a written notice with a complete copy of the Order. We agree. Tiffaney provides that the District Court entered the Order for Payment of Reasonable Attorney's Fees and Costs Awarding Attorney's Fees and Costs on February, 28, 2022. Tiffaney states that the court also1 issued an Amended Order Directing the Disbursement of Deposited Funds on March 1, 2022, after having issued a prior order the day before.
Accordingly, IT IS ORDERED that:
1. Peter's Motion for Extension of Time to File an Amended Opening Brief is DENIED;
2. Peter shall FILE and SERVE a Notice to this Court and include a full copy of the District Court's written Order, dated February 28, 2022, on or before March 30, 2022:
3. Peter shall prepare, serve, and file his Opening Brief on or before April 28, 2022. Failure to file the Notice with a copy of the written Order as well as failure to file the opening brief by the deadlines will result in dismissal of this appeal with prejudice and without further notice.
The Clerk of the Supreme Court is directed to provide a copy of this Order to counsel of record and to Peter Grigg personally.
