Ronald H. Marr, Jr. has moved to "expand the record" in this cause to include additional argument. Our opinion and judgment in the matter were rendered on July 8, 2004, however. Furthermore, his motion, which we construe as one for rehearing, was not filed with this court until September 13, 2004. Prior thereto, he had not requested any extension of the 15-day period (after rendition of our July 8th judgment) to seek rehearing. See TEX. R. APP. P. 49.1. Nor was the deadline extended by this court. Thus, his motion is untimely and denied.
