ORDER ON EMERGENCY MOTION Trial court case number: 14-DCV-214998 Trial court: 505th District Court of Fort Bend County

This Court's November 8, 2016 Order had, among other things, abated for the new respondent "to enter a written and signed order setting a hearing on the relator's motion to transfer venue or else a written and signed order ruling on the motion." On November 10, 2016, the relator, Terr'l La'Yonne Mark, filed this "Emergency Motion to Reinstate Case on this Court's Active Docket and to Abate the Fort Bend Proceedings." Relator claims, among other things, that "[t]his Court's November 8, 2016 Order violates Family Code Section 155.204(c) by ordering that a hearing take place " on his motion to transfer venue when that statute provides for transfer without a hearing. Relator's motion attaches a notice of hearing stating that the respondent has set a November 22, 2016 hearing date for his motion to transfer venue.

Relator's motion contains the required certificate of compliance stating that the real parties in interest, Traci Ja'Hon Adams and the Texas Attorney General's Office, have been notified of this motion. See TEX. R. APP. P. 52.10(a). However, because no response has been filed yet, the Court requests a response to the emergency motion by the real parties in interest, if any, within 3 days from the date of this order.
