This proceeding arises out of Cause No. 04-09-20295-CV, styled Alberto Luna v. Transportation Insurance Company, et al., pending in the 293rd Judicial District Court, Maverick County, Texas.

Motion for Rehearing Denied.

MEMORANDUM OPINION


On September 7, 2005, this court denied relator's petition for a writ of mandamus in this proceeding. Alberto Luna has filed a timely motion for rehearing. This court is of the opinion that the motion for rehearing should be denied. However, we withdraw our opinion issued on September 7, 2005, and substitute this one in its place.

On August 22, 2005, relator filed a petition for a writ of mandamus. This court has determined that relator is not entitled to the relief sought. Therefore, the petition is DENIED. Tex.R.App.P. 52.8(a). No costs shall be assessed against relator because he is indigent. Tex.R.App.P. 20.1.
