Opinion

CASE NO. 07-21027 JPK, ADVERSARY NO. 08-2133.

June 18, 2009

ORDER DISMISSING ADVERSARY PROCEEDING

This adversary proceeding was initiated by a complaint filed on November 12, 2008, at a time when the main case of the debtor was a case under Chapter 13. The apparent purpose for the adversary proceeding was to determine the current mortgage payment to be provided to Countrywide Home Loans with respect to a secured claim of that creditor in the debtor's residence. The underlying case, case number 07-21027, was converted to a case under Chapter 7 by order entered on November 28, 2008. The record in case number 07-21027 discloses that the debtor was granted a discharge in that case on March 16, 2009, and that an order closing the case was entered on that same date. As a result, the matters to which the adversary proceeding were directed do not involve administration of a bankruptcy case, and the court lacks subject matter jurisdiction over those matters.

IT IS ORDERED that the above-designated adversary proceeding is dismissed, without prejudice.
