ORDER

This appeal is from a divorce decree signed February 17, 2017. Appellant filed a notice of appeal on March 13, 2017. Appellant, an inmate, filed a motion to proceed in forma pauperis in this court. See Tex. R. App. P. 20.1. Appellant was notified that his appeal would be dismissed if he did not comply with section 14.004 of the Texas Civil Practice and Remedies Code. Because chapter 14 of the Civil Practice and Remedies Code does not apply to actions filed under the Family Code, the notice was sent in error. See Tex. Civ. Prac. & Rem. Code Ann. § 14.002. Appellant's motion is granted. Appellant is deemed indigent in this court and is entitled to proceed without payment of costs.

Accordingly, the Harris County District Clerk is directed to file the clerk's record within 30 days of the date of this order.
