ORDER
Cypress Texas Lloyds filed a petition for writ of mandamus. The relator is a defendant in Cause No. D-183,180, Kevin Newman and Chantel Newman v. Cypress Texas Lloyds, et al. Relator seeks a writ compelling the Honorable Bob Wortham, Judge of the 58th District Court, to withdraw its order granting a motion to compel discovery. We note our jurisdiction over this matter and the parties. See Tex. Gov't Code Ann. § 22.221 (West 2004).
Relator alleges that on February 14, 2011, the trial court made a verbal order that relator produce allegedly confidential documents by February 15, 2011 at 8:00 a.m. Relator alleges prejudice will result if the production of documents occurs before the issues raised in the petition for writ of mandamus can be resolved.
The Court finds temporary relief is necessary to prevent undue prejudice. It is ORDERED that the trial court's order to produce documents by 8:00 a.m. on February 15, 2011, is STAYED until our Opinion issues or until further order of this Court. See Tex. R. App. P. 52.10(b). No bond is required of the relator as a condition to any relief herein granted.
The response of the real parties in interest, Kevin Newman and Chantel Newman, is due February 25, 2011, at 5:00 p.m.
