ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.211(E)(2), orders:

The prosecutor's confession of error is APPROVED. MCR 7.211(C)(7). The February 3, 2023, order determining that defendant was a person requiring involuntary mental health treatment, which was entered following a bench trial, is VACATED. As the parties agree, defendant was entitled to a jury trial in this matter. MCR 5.740. Therefore, this matter is REMANDED to the trial court for a new trial by jury unless defendant waives a jury trial.

The Court does not retain jurisdiction.
