Opinion

No. 05-08-00904-CV

Opinion Issued July 14, 2008.

Original Proceeding from the 401st Judicial District Court Collin County, Texas, Trial Court Cause No. 401-55057-07.

Before Justices WHITTINGTON, FITZGERALD, and LANG-MIERS.

MEMORANDUM OPINION

In this petition for writ of mandamus, relator complains the trial judge erred in granting real party's motion for specific performance and in denying relator's motion to sign decree of divorce. Based on the record before us, we conclude relator has not shown the trial judge clearly abused his discretion. In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004); Walker v. Packer, 827 S.W.2d 833, 839-840 (Tex. 1992). Accordingly, we DENY relator's petition for writ of mandamus. See Tex. R. App. P. 52.8.
