ORDER

The motion to waive fees is GRANTED for this case only.

The motion for immediate consideration is GRANTED.

The complaint for superintending control is GRANTED and this matter is REMANDED to the Berrien County Trial Court for entry of an order resolving the emergency motion to enforce second plea agreement. Attorney General v Shaw, 277 Mich. 187, 190-191; 269 N.W. 138 (1936). The trial court shall enter an order within 24 hours of receiving this Court's order. This order has immediate effect. MCR 7.215(F)(2). This Court does not retain jurisdiction.

The motion for stay is DENIED.

Shapiro, J., would grant the motion for stay.
