MEMORANDUM OPINION


The Court GRANTS relator's request to dismiss this original procee ding. Accordingly, the Court DISMISSES this original proceeding as moot. See Tex.R.App.P. 52.8(a); Holcombe v. Fowler, 9 S.W.2d 1028 (Tex. 1928) (orig. proceeding) ("mandamus will not issue if for any reason it will be useless of unavailing"). The Court VACATES the stay order issued August 19, 2004.
