ORDER
Debtor has noticed out its intent to settle with Sandra Caudle, after participating in mediation. No order approving the settlement has been submitted, as yet, and no opposition to the proposed settlement has been filed in this case. Underlying the noticed settlement is a matter which has been under submission, concerning debtor's objection to the proof of claim filed by Sandra Caudle, which debtor contends was filed after the claims bar date had passed.
Ostensibly as a separate matter, the OCC filed a motion for a new claims bar date, which was taken under submission contemporaneously with the Caudle claim objection.
The Court needs to know whether: 1) the Caudle claim objection has been resolved by the noticed settlement; 2) if so, where is the order so providing; and 3) whether the OCC still seeks a new claims bar date if the Caudle claim is resolved.
Counsel for debtor, counsel for Ms. Caudle, and counsel for the OCC shall each advise the Court of their respective views on the foregoing questions, in a pleading, filed and served on or before April 8, 2013. The responses will advise the Court whether any of the foregoing issues will require a further decision. If so, those matters will again be under submission.
