Original Mandamus Proceeding

ORDER

Sitting: Sandee Bryan Marion, Chief Justice Rebeca C. Martinez, Justice Liza A. Rodriguez, Justice

On May 19, 2020, relators filed a petition for writ of mandamus, a motion for stay pending final resolution of the petition for writ of mandamus, and a motion to transfer the record from an appeal to this original proceeding. This court believes a serious question concerning the mandamus relief sought requires further consideration. See Tex. R. App. P. 52.8(b). The respondent and the real parties in interest may file a response to the petition in this court no later than June 5, 2020. Any such response must conform to Texas Rule of Appellate Procedure 52.4.

Relators' request for a stay is GRANTED. The trial court's April 23, 2020 "Order of Referral to Mediation" is STAYED pending final resolution of the petition for writ of mandamus.

Relators' motion to transfer records is GRANTED IN PART and the Clerk of this court is instructed to transfer the one-volume clerk's record filed in appellate cause number 04-19-00381-CV to this original proceeding.

Because the mandamus record contains transcripts of the relevant reporters' records and copies of certain records issued by this court in the appeal, the motion to transfer is DENIED with respect to relators' request to transfer these records to this original proceeding.
