Opinion

No. 05-04-01448-CV

Opinion Issued October 13, 2004.

Original Proceeding from the 44th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 03-05643-B.

Writ of Mandamus Denied.

Before Justices WHITTINGTON, FITZGERALD, and LANG-MIERS.

MEMORANDUM OPINION

Relator contends the trial judge erred in ordering production of certain documents. The record before us contains oral statements and fax transmissions from the trial judge announcing his intended ruling. However, we do not find a written order requiring relator produce the documents. Accordingly, relator's motion for emergency stay and petition for writ of mandamus are DENIED. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-842 (Tex. 1992) (orig. proceeding).
