Opinion

No. 05-17-01284-CV

IN THE MATTER OF K.M.D.

On Appeal from the 305th Judicial District Court Dallas County, Texas
Trial Court Cause No. JD-17-01047-X

ORDER

Appellant's brief in this juvenile certification case is overdue. By postcard dated January 25, 2018, we notified appellant his brief was overdue and directed appellant to file his brief and an extension motion within ten days. To date, appellant has not filed his brief or an extension motion, nor has he otherwise corresponded with the Court regarding the status of appellant's brief.

Because this is a juvenile certification case and it is to be disposed of expeditiously, we ORDER appellant to file his brief by February 26, 2018. See Supreme Court of Texas Misc. Docket No. 15-9156 Order Accelerating Juvenile Certification Appeals (appellate courts should ensure appeals are brought to final disposition within 180 days of the date the notice of appeal is filed). We caution appellant that failure to file a brief by that date will result in the Court taking whatever measures it deems necessary to assure effective representation, which may include remanding to the trial court for a hearing to determine whether appellant desires to prosecute the appeal and if so, to determine if it is necessary to appoint new counsel.

CHIEF JUSTICE
