MEMORANDUM OPINION


Relator KLS Air Express, Inc. has filed a petition for a writ of mandamus complaining of actions by Judge Elrod. Relator has now filed an unopposed motion to dismiss its petition because there is no longer an in issue in controversy.

The Honorable Jennifer Walker Elrod, judge of the 190th District Court of Harris County, Texas. The underlying lawsuit is Associated Global Sys., Inc. v. FSP, Inc., No. 2003-65142 (190th Dist. Ct., Harris County, Tex.).

We dismiss as moot the petition for a writ of mandamus.
