IN RE ROMEO KISON, Relator
ORIGINAL PROCEEDING WRIT OF HABEAS CORPUS 295th District Court Harris County, Texas Trial Court Cause No. 2019-23138
Panel consists of Justices Jewell, Spain, and Wilson.
ORDER
PER CURIAM
On October 13, 2023, relator Romeo Kison filed a petition for writ of habeas corpus in this Court. See Tex. Gov't Code Ann. § 22.221; see also Tex. R. App. P. 52. In the petition, relator asks this Court to compel the Honorable Donna Roth, presiding judge of the 295th District Court of Harris County, to vacate: (1) the trial court's October 9, 2023 order revoking suspension of sentence of contempt and for Romeo Kison's commitment to Harris County Jail; and (2) the trial court's October 13, 2023 order of commitment.
Relator's petition does not comply with the Texas Rules of Appellate Procedure. See Tex. R. App. P. 52. For example, relator has not provided a complete list of the identity of the parties and their counsel. Relator has neither identified the real parties in interest nor certified that counsel for the real parties in interest have been served with the petition. See Tex. R. App. P. 52.3(a).
Relator's appendix does not contain certified or sworn copies of the complained of orders and a certified copy of proof that the relator is being restrained. See Tex. R. App. P. 52.3(k).
Further, relator did not file a record. Relator must file with the petition "a certified or sworn copy of every document that is material to the relator's claim for relief and that was filed in any underlying proceeding." Tex. R. App. 52.7(a)(1). Moreover, relator must file with the petition "a properly authenticated transcript of relevant testimony from any underlying proceeding, including exhibits offered in evidence, or a statement that no testimony was adduced in connection with the matter complained." Tex. R. App. 52.7(a)(2).
By this order, the Court gives relator notice that his petition for writ of habeas corpus may be dismissed unless relator amends his petition to address the issues identified above on or before 5:00 p.m. on October 19, 2023.
