Original Mandamus Proceeding.

This proceeding arises out of Cause No. 2002-CI-08959, styled Commission for Lawyer Discipline v. Morris J. Kirschberg, in the 73rd Judicial District Court, Bexar County, the Honorable Andy Mireles presiding. Although Judge Mireles is the permanent judge of the 73rd District Court, relator complains of the ruling of the Honorable Guilford L. Jones, who signed the order at issue in this proceeding.

MOTION FOR EMERGENCY RELIEF DENIED; PETITION FOR WRIT OF MANDAMUS DENIED.

MEMORANDUM OPINION


On November 19, 2003, relator Morris J. Kirschberg filed a petition for writ of mandamus, alleging the trial court abused its discretion by failing to stay his disciplinary suspension pending appeal. This court has determined that the relator is not entitled to the relief sought. Accordingly, relator's petition for writ of mandamus is denied. See Tex.R.App.P. 52.8(a). Relator shall pay all costs incurred in this proceeding.
