STIPULATION AND CONSENT ORDER RESOLVING U.S.TRUSTEE'S
MOTION TO CONVERT OR DISMISS
The United States Trustee moved to convert the case to chapter 7 or to dismiss same, and the Debtor answered. The parties have conferred and propose terms for resolving the motion. Since the filing of the Motion to Convert or Dismiss, the Debtor has tendered funds in payment of overdue Quarterly fees. The Debtor agrees to pay such fees timely hereafter. The Debtor has not filed reports during the case. The Debtor agrees that by January 15, 2013, the Debtor shall file a cumulative report for the period March 19, 2012 through December 31, 2012, and shall file thereafter reports by the 15th of each month for the calendar month preceding. The Debtor shall file a plan and disclosure statement by January 13, 2013. Debtor agrees that if it fails to perform per the above in any respect, it consents to the dismissal of the case, without further notice and hearing, upon the certification by the U.S.Trustee.
