MEMORANDUM OPINION


Relator contends the trial court abused its discretion by granting a motion for new trial after it had lost plenary jurisdiction. Relator's petition is not verified. See Tex. R. App. P. 52.3. Accordingly, relator's petition for writ of mandamus is DENIED. See Tex. R. App. P. 52.8 (a).
