Opinion

No. 05-05-00804-CV

Opinion issued June 15, 2005.

Original Proceeding from the 160th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 90-9914-a/H.

Writ of Mandamus and Prohibition Denied.

Before Justices WHITTINGTON, FITZGERALD, and LANG-MIERS.

MEMORANDUM OPINION

Relator contends the trial judge erred in denying his motion to enforce mandate and not dismissing a plea in intervention. Based on the record presented, we conclude the trial judge did not abuse his discretion in denying the motion to enforce mandate and not dismissing the plea in intervention. Accordingly, relator's motion to stay proceedings and petition for writ of mandamus and prohibition are DENIED. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-842 (Tex. 1992) (orig. proceeding).
