THE COURT:

It is ordered that the opinion filed herein on December 1, 2011, be modified as follows:

The paragraph under the heading “Disposition” on page 17 is modified to read as follows:

The juvenile court order terminating father’s parental rights is reversed. The matter is remanded to the juvenile court with directions that the juvenile court shall direct the Department to comply with the notice provisions of ICWA. If Keith is determined to be an Indian child, a new hearing shall be held. If he is determined not to be an Indian child, the order terminating parental rights shall be reinstated.

This modification changes the judgment. Respondent’s petition for rehearing is denied.
